Pittsylvania Ag Development Board FOIA case to be re-heard on Thursday, August 6th

I’ll be watching carefully as this issue is brought before the court again.

The issue here is whether there is sufficient evidence to prove that county officials acted illegally in calling a closed meeting to discuss personnel issues, and also forcing citizens out of the meeting without any evidence or ability to know about whether the county officials returned from executive session with the proper motions and documentation.

There was, after all, no one there to witness the end of the closed meeting, and the returning motion to certify that only issues that fall under permitted uses for a closed meeting were discussed at the time.

Also, only issues in the motion to retire to executive session are allowed to be discussed, unless successfully voted on in order to add issues. This action also requires notice when returning from closed session.

The certification is a required part of an executive session according to Virginia Code.
